1. The Plaintiff:
A. The Seoul Guarantee Insurance Co., Ltd., and the Seoul Guarantee Insurance Co., Ltd., jointly and severally KRW 1,525,642,047 and KRW 1,527.
Reasons
1. Basic facts
A. The Korea National Housing Corporation is a project proprietor who newly built and sold 1,188 households (hereinafter “instant apartment”) located in Seo-gu Daejeon, Seo-gu, Daejeon (20 to 25 stories) and the Plaintiff comprehensively succeeded to the rights and obligations of the Korea National Housing Corporation on October 1, 2009.
B. On November 28, 1995, the Korea National Housing Corporation concluded a contract for the construction of the instant apartment, a contract for the construction of the instant apartment, a third-electronic company and the instant apartment, a contract for the construction of telecommunications construction of the instant apartment, and a contract for the construction of the instant apartment, and a contract for the construction of the instant apartment. Of the contractor’s obligations under each of the above contract, the Korea National Housing Corporation concluded a contract for the construction of the instant apartment, with the Defendant A, respectively. (B) According to the above contract, the warranty liability period is 18 years in the case of walls, columns, floors, beams, roof, main stairs, five years in the case of machinery, landscaping, and civil engineering, two years in the case of machinery, landscaping, and two years in the case of other cases, and Article 11(1) of the Multi-Family Housing Management Rules.
C. On September 29, 1999, the Defendant Seoul Guarantee Insurance Co., Ltd. concluded a performance guarantee insurance (e.g., defects) with the content of the insurance as a defect guarantee bond with regard to the instant apartment construction work, setting the policyholder and the insured as the Korea National Housing Corporation, and the contents of the guarantee as the defect guarantee bond, and issued the insurance policy.
