C. The defendant B shall be punished by imprisonment with prison labor for three months and by imprisonment for two months.
Reasons
Punishment of the crime
Defendants of the 2017 Highest 4576, both of whom were known at the juvenile reformatory or the club, and Defendant C conspiredd to play a role in lending cell phoness used in committing fraud and body cards, etc. from their relatives or feass, and withdrawing the deposited fraud damage amount. The Defendants C posted a letter of intent to sell goods on the Internet goods transaction site using mobile phones and deceiving people by communicating them with people, Defendant B, D, and E.
1. Joint crimes committed by the Defendants
A. On November 23, 2016, the Defendants posted a notice to the effect that “a traffic card is sold” on the Internet NVV and the Korean carpet bulletin board, and made a false statement to send a traffic card to the victim JH who contacted with the notice.
However, the Defendants did not have the intention or ability to deliver the goods even after receiving the traffic card payment.
The Defendants deceptioned the victims as above, and received 150,000 won from the Busan Bank JJ account under the name of JI on the same day as the price for goods.
B. On January 12, 2017, the Defendants posted a letter to the effect that “as to sell books to 1.30,000 won” on the Internet Internet NAV bulletin board of the Republic of Korea, and made a false statement to the effect that the Defendants would send books to the victim JK who contacted with the Defendants.
However, the Defendants did not have the intention or ability to deliver the goods even if they received the payment.
The Defendants deceptioned the victims as above, and received 130,000 won from the Busan Bank JM account under the name of JL on the same day.
2. Defendant C
A. On February 16, 2017, the Defendant, in collusion with D and E, posted a notice to the effect that “the traffic card is sold at KRW 185,00,00” on a bulletin board of the Internet NVV and the Republic of Korea, and sent money to the victim JN who visited the notice.
