1. The plaintiff's claim is dismissed.

1. Basic facts

A. On August 13, 2013, the Plaintiff and the Defendant concluded a sales contract (hereinafter “instant sales contract”) with the Defendant to purchase land of 770 square meters in the Guro-gu, Ansan-si, Ansan-si (hereinafter “instant land”).

On the same day, the Defendant paid the Plaintiff the down payment of KRW 40,000,000.

The main contents of the instant sales contract are as follows.

- below - Sales Price: 400,000,000 down payment of KRW 40,000,000, the balance of KRW 360,000,000 ( October 10, 2013 on the date of payment) is to complete the extension of the road works (three meters) in its entirety before the remainder.

(for the exclusive use of approximately 50 square meters for rural construction: 1,250,000 won, 3 years agreement, and 50 square meters for buyers)

B. On October 10, 2013, the Plaintiff and the Defendant newly drafted a sales contract on the instant land with the content that the payment date of the remainder of the instant sales contract would be changed to November 5, 2013.

C. On November 5, 2013, the Defendant paid KRW 310,000,000 to the Plaintiff out of the remainder of the instant sales contract, and prepared and executed a cash storage certificate (hereinafter “instant cash storage certificate”) with the following contents.

- The following amount: 50,000,000 won shall be received periodically on November 5, 2013, and shall prepare and affix a written name and seal to receive (storage) the above amount.

The above (including entry road construction costs) amount shall be kept by the purchaser from among the balance of the purchase and sale of the instant land for storage reasons, and the road construction works shall be executed by the design drawings, and the payment of the storage amount due to the said case shall be determined by consultation between the seller and the purchaser.

Of the storage cost of KRW 50,000,000, KRW 20,000 out of the storage cost of KRW 50,000 shall be paid at the above-mentioned access road construction cost of KRW 20,000,000, the seller shall issue to the seller in the future, and the seller shall pay KRW 1,90,000 out of the design cost of KRW 4,400,000 out of the construction cost of KRW 20,00,000.
