1. The defendant shall pay to the plaintiff KRW 99,834,245 and the amount of KRW 95,897,945 among them, from May 23, 2013 to the date of full payment.
Reasons
1. Comprehensively taking account of the purport of the entire argument in Gap evidence No. 6, the defendant's business registration is recognized as having been filed on September 8, 201, by making the location of the location of the branch-story C (B)-101 (hereinafter referred to as "the instant apartment building") on the land outside and six parcels of Yongsan-si, Suwon-si (hereinafter referred to as "the instant apartment building").
2. The party's assertion and judgment
A. The Plaintiff asserts that the Defendant is obligated to pay KRW 99,834,245, including unpaid management expenses, etc. from November 2, 2012 to February 2013, 201, as the Plaintiff operated the instant private house from September 8, 2011 to May 1, 2013.
As to this, the Defendant asserted to the effect that the instant friendship was operated only from September 27, 201 to March 16, 2012, and that the Plaintiff did not have any obligation to pay management expenses, etc. for the period claimed by the Plaintiff, since all management expenses corresponding to the said period were paid to the Plaintiff.
B. In full view of the written statements in Gap evidence Nos. 1 through 16 (including branch numbers; hereinafter the same shall apply) and witness D's testimony, the plaintiff concluded an entrustment contract with the management body of the instant aggregate building around the end of November 2008 and managed the instant aggregate building since that time (the trade name of the plaintiff was "T&AB management" at the time and was changed as of March 2, 2012). ② The management body agreement of the instant aggregate building provides that "the possessor has the same obligation as that of a sectional owner in relation to the use of the building, site, and attached facilities (Article 6-2.)" (Article 6.2.) provides that "the possessor shall bear the management expenses incurred in the maintenance and management of the building" (Article 7-7.7) and the "E is the location of Suwon District Court's purchase of the instant letter or the instant letter in the auction procedure for the instant real estate and as of March 2, 2010.
