A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 01:00 to 03:00 on September 27, 2015, the Defendant assaulted the victim’s face on several occasions at the entrance of the E Apartment apartment near the D Station located in Seocheon-gu, Seocheon-gu, Seocheon-si, from February 2015, 2015.
2. Violation of the Road Traffic Act;
A. On November 8, 2015, around 06:50, the Defendant driven a HK5-car without a car driver’s license on a approximately 6km section from the 265-gil to the Defendant’s house located in Seocheon-si G from the 29-gil-si, Seocheon-si, Seocheon-si, to the Defendant’s house adjacent road in Seocheon-si.
B. On November 9, 2015, at around 15:30, the Defendant driven the said K5-car without a car driver’s license from the front day of the “JH club” to the roads adjacent to the Southern-gu Incheon Metropolitan City, Seocheon-si, the Defendant, working for the said K5-car without a car driver’s license.
3. The Defendant causing property damage: (a) around 06:50 on Nov. 8, 2015, the Defendant: (b) was driving a woman having come to know of the “LA club” located in Seocheon-gu, Seocheon-gu, Seocheon-si, Seocheon-si, in a situation where it was possible for the Defendant to contact with the Defendant FF driver’s vehicle while driving the above K5 vehicle on board; (c) the victim was determined to have committed a crime such as taking measures after the accident under the Road Traffic Act; (d) driving under the influence of alcohol; and (e) driving without license; and (e) the “05:5” written indictment written at around 06:55 on the same day is deemed to have been written in writing (Evidence No. 10 of the evidence record)
The defendant was reported to the superior police station of the 1,000 U.S. police station.
At around 09:30 on the same day, the Defendant proposed that the Defendant was defective in the “P” restaurant located in Seocheon-si, Seocheon-si, Seocheon-si, Seocheon-si, and the Defendant and the victim also made the foregoing 10:30 on the same day.
