Summary of Facts charged

1. No person who is not a business operator shall sell foods, etc. manufactured, processed, or subdivided by a person who is not a business operator, or gather, manufacture, import, process, use, cook, store, subdivide, transport or display them for sale.

Nevertheless, around August 4, 2011, the Defendant: (a) around 201, the Defendant: (b) sold a salt and sweeded mixed substance (hereinafter referred to as “sweeded mixed substance”) of KRW 450 per km in order to create the fish into the salted fish, such as a difficult sweed, manufactured, processed, etc. without obtaining a business license from the Defendant’s father; (c) around August 4, 201, around 26,00 g; (d) around August 4, 2011, around 26,16,11, 26,160 gg; (d) the total market price of KRW 23,472,00 g, the total market price of KRW 23,160 g,52,160 g.

Accordingly, the defendant sold food manufactured or processed by a person who is not a business operator.

2. No person who is not a business operator shall sell foods, etc. manufactured, processed, or subdivided by any person who is not a business operator, or gather, manufacture, import, process, use, use, cook, store, subdivide, transport or display them for sale.

Nevertheless, around August 4, 2011, the Defendant: (a) knew of the fact that H, the father of D, was manufactured or processed without obtaining a business license; (b) even though he knew of the fact, the Defendant: (c) extracted the salted fish from the salted fish mixed; and (d) extracted the salted fish so manufactured or processed from D to sell it; and (c) transported the salted fished fished fished at KRW 23,472,00 in the aggregate market price of KRW 26,160 in August 9, 201; and (d) transported the processed fished fished at KRW 52,160 in Seo-gu, Seo-gu; and (e) transported the salted fished fished at KRW 23,472,00 in the market price of KRW 26,160 in Seo-gu.

Accordingly, the defendant transported food manufactured/processed by a person who is not a business operator for the purpose of sale.

3. Around August 2011, Defendant E, a de facto representative of the Defendant, transported food manufactured/processed by a person, other than a business operator, for sale, as described in paragraph 2.
