1. The Defendants are jointly and severally liable to each of the Plaintiffs for KRW 215,00,000 and the aforementioned amount from October 31, 2016 to March 21, 2018.
Reasons
1. Facts of recognition;
A. The status of Plaintiff B is Plaintiff A’s infant, and Defendant C is Defendant D’s spouse.
B. On August 8, 2013, Plaintiff B and Defendant C received an investment certificate from Defendant C, stating that “The above amount was invested by Plaintiff C, and would deposit monthly investment profits, and will guarantee the principal,” the Plaintiff B paid KRW 50 million to Defendant C, and on September 24, 2013, issued an investment certificate stating that “The above amount was invested by Plaintiff C in Defendant C, and will deposit monthly investment profits, and will guarantee the principal.”
3) On April 1, 2014, Plaintiff B lent KRW 45 million to Defendant C, and received a certificate of loan from Defendant C that “The principal will be repaid on the 10th day of each month, and the principal will be repaid by the oral agreement date.” Plaintiff B borrowed KRW 20 million to Defendant C on October 8, 2014, and issued from Defendant C a certificate of loan that “The principal will be repaid by the oral agreement date.”
5 On November 8, 2014, Plaintiff B lent KRW 80 million to Defendant C, and was issued by Defendant C a certificate of loan stating that “The principal will be repaid by the 10th day of each month, and the principal will be repaid by the oral agreement.”
C. On April 18, 2016 between the Plaintiffs and the Defendants, the Plaintiff C filed a criminal complaint against the Defendant C in order that the Defendant C did not pay the Plaintiff a total of KRW 215,000,000 for the said investment and loan. In the process of agreement between the Plaintiff C and the Defendant B, the following loan certificates were prepared on April 18, 2016 between the Plaintiffs and the Defendants.
The name of the debtor of the loan certificate: The plaintiffs - contents - the defendants borrowed KRW 215,00,000 to the plaintiffs.
