A defendant shall be punished by imprisonment for not less than two years and six months.

Seized evidence referred to in subparagraphs 1 through 9, 11, 12, 13, 15 and 16 shall be confiscated.

Punishment of the crime

[criminal history] On February 15, 2007, the Defendant was sentenced to a suspended sentence of one year and six months for a crime of larceny, etc. in support of the development of the Sugwon method and support for larceny at night; on May 30, 2007, the Defendant was sentenced to a suspended sentence of six months for a crime of larceny, etc. at the Jeonju District Court on September 29, 2009; on October 1, 2010, the Defendant was sentenced to imprisonment of ten months for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Daejeon District Court’s Support for the Daejeon District Court on October 1, 201; and on August 13, 2012, the Daejeon District Court was sentenced to imprisonment of one year and six months for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny).

On June 11, 2015, the Defendant was sentenced to one year and six months of imprisonment with prison labor for habitual larceny in support of the development of the methods of flooded land, and the judgment became final and conclusive on June 12, 2015, and completed the execution of the sentence in the lawsuit of two teaching districts in Gyeonggi-do, Gyeonggi-do on September 30, 2016.

[Criminal facts]

1. The Defendant habitually stolen: (a) carried electric wires with equipment capable of cutting electric wires, such as tamping and cutting machines; (b) cut electric wires installed at a construction site, etc. with human resources, with a view to selling them; (c) cut off electric wires; (d) around 04:0 on February 4, 2017, at the victim Korea Electric Power Corporation located in the Daejeon 241, Dong-dong, Daejeon-dong, Daejeon, Daejeon, with a view to selling them; (d) cut off electric wires of an amount of KRW 1,50,00 (50m) at the market price of the electric line located in the area near the Daejeon 241; or (e) cut off electric wires of an amount of KRW 1,00,00,000 at around 03:50 on December 24, 2016, around 3:50,010, the Defendant attempted to cut electric wires to remove electric wires and discover them from D managers, and without doing so over the market price of the victim.

Accordingly, the defendant habitually stolen or attempted to steals the victims' articles.

2. The Defendant is injured.
