[이 법정에서 적법하게 채택하여 조사한 아래 증거들 및 피고인이 제출한 2016. 7. 6.자 탄원서 첨부 사진들에 의하여 인정되는 다음과 같은 사정들을 종합하여 보면, 피고인이 가져간 망치로 피해자 집의 현관문을 3회 내리쳐 위 현관문이 세군데 함몰된 사실이 충분히 인정된다. 피해자는 수사기관에서 당시 현관문에서 “쾅쾅쾅” 소리가 들렸고, 현관문을 열어보니 피고인이 망치를 들고 씩씩거리면서 있었으며, 경찰에 신고를 한 후 현관문을 다시 보니 세군데 함몰이 되어 있었다고 진술하였다. 당시 촬영한 현관문 사진상으로 실제로 둥그런 함몰자국이 세군데 관찰되는데, 피고인이 가져간 망치의 머리부분도 둥그런 모양이다. 또한, 당시 망치를 든 손으로 위 현관문을 3회 두드렸음은 피고인도 자인하고 있는 바이다. 한편, 피고인의 주장에 따르면 위 망치의 머리 직경이 약 3cm라는 것인바, 현관문 앞에 선 상태에서 현관문을 망치로 내리치는 경우 망치머리의 전체가 아닌 그 위쪽 일부분만 현관문에 닿게 되는 것이 보통인 점을 고려하면, 위 함몰자국이 위 망치머리의 크기보다 조금 작은 것(피고인의 주장에 따르면 직경 2cm라고 함 이 오히려 자연스럽다.
