A defendant shall be punished by imprisonment for two years.

Punishment of the crime

1. Around January 9, 2010, the criminal defendant against the victim C made a false statement to the victim “E cafeteria” located under the D of Gyeonggi-si, Gyeonggi-do, stating that “The victim is engaged in the business of importing clothes and horses in China and selling them in the East gate. The money to purchase an article is short of KRW 600,000,000,000,000,000 won will be refunded.”
However, the Defendant did not run the business of importing and returning clothing in China. The Defendant merely planned to use the borrowed money from the victim to repay other debts, etc., and thus did not have any intention or ability to repay the money even if he borrowed money from the victim.
As above, the Defendant, as well as by deceiving the victim and deceiving 600,000 won from the victim, acquired 60,000 won from around that time to May 29, 2010, and acquired 134,648,050 won in total over 73 times, as shown in Appendix I.
2. Around October 2, 2009, the Defendant against the victim F made a false statement to the victim “H” on the front day of the Gyeonggi Ga in front of the Gyeonggi Ga in the event of the economic globalization, stating that “W will have a large amount of profit to enter and depart from China, while doing so, there is a good thing with high profit. When lending money, the Defendant would have approximately 30 to 40% of the profit by purchasing and selling the goods.”
However, for the foregoing reasons, the Defendant did not have any intent or ability to repay the money borrowed from the victim.
As above, the Defendant, by deceiving the victim and deceiving the victim from the victim, acquired KRW 1,00,000 on the same day from the victim, and acquired KRW 46,490,000 in total on 23 occasions from around that time to February 5, 2010, as shown in attached Table II, from around that time.
