A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around March 15, 2015, the Defendant violated the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (including Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes) and the Act on the Punishment, etc. of Sexual Crimes (Use of Cameras, etc.) taken pictures of female images using a camera function of G3 smartphones owned by the Defendant, which carried his hand with his/her hands, from November 13, 2014 to March 20, 2015, by intrusioning female toilets installed at the 332 Busan Bupyeong-ro, Bupyeong-gu, Incheon, Maro-ro, 332, and entering the partitions into the partitions, and taking pictures of female images with the aforementioned images using a camera function as a camera of G3 smartphonephones owned by the Defendant from November 13, 2014 to March 20, 2015.

Accordingly, the Defendant intruded on public toilets for the purpose of meeting his sexual desire more than seven times, and taken the body of another person against his will that could cause sexual humiliation or shame by using the camera function of smartphones on nine occasions.

2. On April 8, 2015, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Influence of public places) committed intrusion on women’s toilets installed on the second floor of the Seo-gu Incheon apartment C at around 16:0 on April 8, 2015, and intruded into public toilets with an intent to satisfy his/her sexual desire by the aforementioned method six times from January 5, 2015 to the above date, such as the list of crimes (Ⅱ).
