1. Facts of recognition;

A. In relation to the real estate (hereinafter “instant real estate”) listed in the separate sheet jointly owned by the Plaintiff (Appointed Party), A, D, and Selected E (hereinafter “Plaintiffs”), Defendant B filed a lawsuit against the Plaintiffs on January 23, 2008, asserting that on November 26, 198, Defendant B had the right to claim for ownership transfer registration based on the transfer agreement as of November 26, 1987. The Incheon District Court rendered a favorable judgment of July 9, 2008 as the Plaintiffs did not submit a written response, and the above judgment became final and conclusive on September 2, 2008.

(hereinafter referred to as the “instant judgment subject to a retrial”) B.

Defendant B, based on the instant judgment subject to a retrial on September 12, 2008, completed the ownership transfer registration based on a transfer agreement (hereinafter “instant first ownership transfer registration”) concluded on November 26, 198, as the receipt of the Incheon District Court Decision No. 110197, supra.

C. As to the instant real estate, Defendant C completed the instant provisional registration of ownership transfer registration based on the instant first ownership transfer registration, ① the Incheon District Court’s receipt of October 1, 2008, No. 116636, Sept. 30, 2008 (hereinafter “instant provisional registration”), and ② the ownership transfer registration based on the sale as of July 6, 2009, No. 66311, the same court’s receipt on July 6, 2009 (hereinafter “second ownership transfer registration”).

On February 11, 2009, the Plaintiffs filed a petition for a new trial with the Incheon District Court 2009Ja27 against the instant judgment subject to a new trial. On August 4, 2010, the Incheon District Court rendered a judgment that “The instant judgment subject to a new trial is revoked, and all Defendant B’s claims are dismissed,” and Defendant B appealed with the foregoing judgment and appealed with the Incheon District Court 2010Ja62, but the Incheon District Court dismissed the appeal on February 18, 201.
