Reasons
Punishment of the crime
The defendant is the owner of Kimcheon-si B main office.
1. On October 3, 2012, around 17:54, the Defendant: (a) acquired a new card lost by victim D; (b) a lot card; (c) a modern card; and (d) a sc-Mawon card; (b) a non-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-c-p-c-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-p-
The Defendant, without taking necessary procedures such as returning the goods acquired as above, embezzled the Defendant’s thought that he had.
2. On October 3, 2012, the Defendant violated the Specialized Credit Financial Business Act: around 18:31, 201, the Defendant collected the No. D’s No.C. Card as stated in paragraph (1) from the card base point operated by the Defendant in Kimcheon-si; on October 3, 2012, the Defendant collected the No.C. Card, totaling KRW 450,000; on October 3, 201, he collected the new card; on the same day, 280,000; and on the same day, he collected the No.C. Card; and around 19:02 on the same day, he collected the No.C. Card, and paid KRW 280,000,000 in total with the amount of alcohol and the amount of alcohol.
Accordingly, the Defendant paid the sum of KRW 1,010,000 with a lost credit card and used the credit card unlawfully.
3. Dec. 3, 2012, the Defendant paid KRW 450,000 with the Nonghyup FFC card, around 19:01 on October 3, 2012, and KRW 280,000 on the same day, with the Nong FC card, around 19:01 on the same day, as in paragraph 2, as if it had been paid a normal alcoholic beverage and salvement payment, as in paragraph 2, with the Nong FC card, around 19:02 on the same day.
As such, the Defendant, by deceiving the No.C.C. Co., Ltd., the victim, received 719,050 won from the victim No.C. card to the account of community credit cooperatives in the name of the defendant, and acquired 719,050 won, excluding fees, and by deceiving the new card company, which is the victim, received 280,000 won. However, the victim D reported the loss of the card.
