A defendant shall be punished by imprisonment for six months.

1. 강제추행 피고인은 2019. 4. 25. 17:25경 울산 동구 B 아파트 관리사무소에서, 엘리베이터 고장을 따지기 위해 방문하여 그곳 직원과 말다툼을 하다가 “신고하겠다.”고 말하고, 위 직원이 “여기 형사가 있다.”고 말하면서 마침 위 아파트에서 발생한 재물손괴 사건의 수사를 위하여 그곳에서 위 아파트에 설치된 CCTV 영상을 확인 중인 울산동부경찰서 C 소속 순경인 피해자 D(여, 32세)을 지목하자, 피해자에게 걸어간 후 피해자에게 “씨발년이, 니 뭐하노 내꺼 보나, 니가 형사가 사복입고 있으면서.”라는 등 욕설하고, 피해자가 휴대폰으로 피고인의 모습을 동영상으로 촬영하려고 하자 피해자로부터 위 휴대폰을 빼앗은 후 “아니 이걸 왜 찍냐 씹할, 내가 뭐 잘못했냐, 진짜 죽여 버릴까.”라고 욕설하며 발로 피해자를 찰 것 같은 태도를 보이고, 손으로 피해자의 왼쪽 팔뚝 부위를 3~4회 만지며 잡아당기고, 이에 피해자가 “만지지 마세요. 왜 이러세요.”라고 말하는데도 피해자의 가슴 쪽으로 손을 뻗어 손가락을 오므렸다가 펴며 피해자의 가슴을 쥘 듯한 태도를 보이면서 피해자에게 “내가 니 젖가슴까지 움켜쥘 수 있어. 왜냐면 당신 공무원이 이 양반아 사복을 그게 뭔가 비리가 있다는 거야.”라고 말하고, 피해자에게 다가가 피해자의 손을 잡으려고 하고, 피해자가 이를 뿌리치자 피해자에게 “젖가슴.”이라고 말하면서 피해자의 가슴 쪽으로 다시 손을 뻗었다.
