1. The Defendants owned the Plaintiff’s 1,144 square meters of E forest in Ansan-si, and the 68,411 square meters of F forest in Busan-si, the list of shares in annexed Form 1.
Reasons
1. Facts of recognition;
A. On April 7, 1994, the Plaintiff accepted the portion to be incorporated into the roads among 68,331 square meters of forest land in Dosan-si prior to the division for the construction of roads as part of the G Gun road development project, but at the time, the Plaintiff completed the registration of ownership transfer on June 1, 1995 as to the shares of 1,124/68,31 square meters of land among the above land.
B. On December 11, 2013, the instant land was corrected to a size of 69,555 square meters on the grounds of boundary correction.
On January 26, 2015, the Plaintiff may file a request with the landowner pursuant to this Act for any of the following persons under Article 87 (Subrogation of Application) of the former Act on Land Survey, Waterway Survey and Cadastral Records (Amended by Act No. 12738, Jun. 3, 2014);
1. In cases of land classified as a school site, road, railroad site, bank, river, ditch, marsh, water supply site, etc. due to a public project, etc.: The implementer of the relevant project;
2. In the case of land acquired by the State or a local government: The head of an administrative agency or the head of a local government (hereinafter referred to as the "head of a local government") who manages the relevant land, who has filed an application for the partition and registration conversion of the relevant land
C. On February 2, 2015, the instant land was divided into 68,411 square meters of F forest land in Ansan-si (hereinafter “1 land after division”) and 1,144 square meters of E forest land in Asia-si (hereinafter “1” in the attached Form 2 indication”), and the registration of subdivision was completed on the following day.
