Reasons
1. Basic facts
A. The Plaintiff entered into a lease agreement with G Co., Ltd. (hereinafter “G”) (hereinafter “E”) which is the former owner of the portion (a) in the attached Form 2.1, (2), (3), (4), and (1) the part (a) in the attached Form 1. of the underground floor of the real estate listed in the attached Table 1 (hereinafter “instant building”), and the lessee, and E Co., Ltd. (hereinafter “E”) (hereinafter “E”), on September 16, 2014, indicating that the registration of ownership is completed with respect to the instant building.
B. On June 30, 2006, the Plaintiff entered into a sublease contract with the Defendant to pay the rent of KRW 1 million per month for the instant store, and the rent for the owner G directly. At that time, the Defendant occupied and used the instant store by delivery from the Plaintiff.
C. Since then, the above sub-lease contract between the Plaintiff and the Defendant has been renewed each year, and the Plaintiff concluded a sub-lease contract with the Defendant from June 1, 2010 to May 31, 201, and from June 1, 2010 to May 31, 201, the 500,000 won of the sub-lease deposit, the 60,000 won of the rent monthly, and the 600,000 won of the rent for the owner G, and the Defendant directly paid the rent to the Defendant, but after the two months of the rent and the rent for G, the instant sub-lease contract has been renewed each year. Since then, the Plaintiff and the Defendant gradually reduced the rent from around 2015 to KRW 30,00 of the rent and the 264,00 of the rent for the owner E, the Defendant directly paid the rent to the Defendant.
The defendant has continuously failed to pay the rent during the period of sublease, and the total amount of the rent of KRW 4,862,00 (including the total of KRW 792,00,000,000 paid by the plaintiff on behalf of the defendant, as of March 31, 2017, after deducting the deposit money paid by the defendant from the total amount of the rent in arrears.
