1. The defendant shall be punished by imprisonment for one year;

2. The certificate of seizure shall be set forth in subparagraph 1 (one electronic liveul), No. 2 (one small liveule) and increase.

Reasons

Punishment of the crime

The defendant is not a person handling narcotics, and shall not trade, administer, possess narcotics or psychotropic drugs.

1. On June 19, 2013, the Defendant: (a) sent KRW 500,000 to F in cash from EK5 cars owned by the Defendant that was parked in D located in Gangnam-gu Seoul, Gangnam-gu; and (b) delivered approximately one gram of psychotropic drugs contained in vinyl paper (hereinafter “clopon”).

The Defendant, including this, sold a penphone to a male residing in Incheon through G on two occasions from June 1, 2013 to July 30, 2013, and purchased a penphone from F and H on six occasions.

2. On June 22, 2013, the Defendant: (a) parked in the vicinity of the J hotel located in Gangnam-gu Seoul, Gangnam-gu, Seoul; (b) laid down approximately 0.03 grams of philopon at the above K5 car; and (c) inhaled the said philopon to his co, and inhaled the said philopon.

The Defendant, including this, administered philophones independently or in collusion with K during a total of 25 times from April 2013 to August 2, 2013, as shown in [Attachment Table 2].

3. At around 14:00 on August 2, 2013, the Defendant possessed a vinyl paper containing 0.2g of psychotropic drugs, and vinyl paper containing 0.45g of philophone, in the Defendant’s residence located in Namyang-si, Namyang-si, LMA 8dong 1009, and a vinyl paper containing 0.45g of philophone, respectively, in a way of placing it in the Defendant’s front right part of the Defendant’s office.
