A defendant shall be punished by imprisonment for up to seven months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, with the trade name of “C” in Gangseo-gu Busan Metropolitan City, was a person operating a recycling company, who has stolen iron bars, etc. from the construction site or the open space, around the construction site and neglected to dispose of them.

1. On February 10, 2020, around 23:59, the Defendant: (a) committed theft against the victim D (hereinafter “F”); (b) was loaded and stolen on the Defendant’s loading of a Hpoter vehicle with the Defendant’s KRW 50,000 of the market price managed by the victim D affiliated with G at the location of the new construction site of “F” located in Gangseo-gu Busan Metropolitan City.

2. Larceny against victim I;

A. From around 18:00 on March 17, 2020 to around 01:50 on the following day, the Defendant: (a) committed a theft by carrying the following points on the vehicle loaded at a new construction site of “K” located in the Gangseo-gu Busan Metropolitan GovernmentJ; (b) the safety distress 38 points at the market price equivalent to KRW 1,50,000, and the safety distress 23 points at the safety distress vehicle operated by the Defendant.

B. The Defendant: (a) at the new construction site of “N” located in Gangseo-gu Busan, Busan; (b) at the market price of KRW 240,000,000, which was managed by the said victim; (c) stolen the Defendant’s loading of the said cargo onto the Defendant’s vehicle with four points on board the aforesaid cargo vehicle, where the Defendant was operating.

C. The Defendant: “P” construction site located in the Gangseo-gu Busan Metropolitan Government O; “P” 1,00,000 won in the market price managed by the said victim; and “P” 14 points in the franchise poppy and 7 points in the franchise poppy cover, which the Defendant loaded onto the pool vehicle operated by the Defendant.

3. On March 18, 2020, around 01:50 on March 18, 2020, the Defendant: (a) discovered a new construction site of “S” located in the Gangseo-gu Busan Metropolitan Government R; (b) loaded three iron bars with the market price equivalent to KRW 90,000 in the market price where Q from the victim Q from T was managed by the Defendant; and (c) loaded them onto the vehicle of the said bus in operation by the Defendant.
