1. The Plaintiff:
A. Defendant A Co., Ltd.: (a) KRW 534,504,464 and KRW 133,227,827 among them, respectively, shall be from February 21, 2014 to February 21, 2014.
Reasons
1. Basic facts
A. The Defendant A Co., Ltd. (hereinafter “Defendant A”) concluded three monetary loan agreements with the Seoul Bank (hereinafter “Seoul Bank”) as follows, and received the corresponding loans from the Seoul Bank. At the time of concluding each monetary loan agreement, the Defendant B (Appointed) and the Party B (hereinafter “Defendant B”) concluded three comprehensive loan agreements with the Seoul Bank to guarantee jointly and severally the liabilities owed by the Defendant A to the Seoul Bank within the limit of KRW 65,000,000, respectively.
On September 1, 1997, 46,450,384 of ordinary loan loans (designated parties) 65,00,000,000 of the network I, Defendant 47,733,864 of the deed loan on September 20, 1997, Defendant 65,00,000,000 of the network I, and Defendant 49,043,579,579 of the deed loan on October 10, 1997 (appointed parties), and Defendant 65,00,000,000 of the deed loan on October 10, 1997, respectively.
B. However, Defendant A failed to pay the principal and interest of the loan under each of the above monetary loan agreements.
C. On the other hand, on September 14, 1999, the Seoul Bank transferred the principal and interest of the loan to the Plaintiff according to the above monetary loan contract, and notified the Defendant A of the assignment of the loan. D. on September 27, 1999
Since then, the plaintiff filed a lawsuit against the defendants and deceased I as Seoul Central District Court 2003Gahap73199, and was sentenced by the above court on April 2, 2004 to the following purport. The above judgment became final and conclusive around that time.
The Plaintiff
A. Defendant A shall pay 276,610,206 won and 143,227,827 won per annum from September 26, 2003 to April 2, 2004; and 20% per annum from the following to the date of full payment;
B. Defendant B and the network I are jointly and severally with Defendant A.
Of the 276,610,206 Won 195,000,000, respectively, the entry in the port shall be 276,610,206.
