1. The Defendants jointly and severally committed against Plaintiff A, 1,691,08,485 won, and 1,583,47,944 won, and Plaintiff C.

1. Basic facts

A. The parties concerned 1) H Housing Redevelopment and Improvement Project Association (hereinafter “instant partnership”)

H Housing Redevelopment Improvement Project (hereinafter referred to as the “instant Project”) in Bupyeong-gu, Incheon.

In order to promote the Act, the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents on February 24, 2010 (hereinafter “Urban Improvement Act”) shall apply.

(2) The Plaintiffs were selected as the contractor of the instant project from the instant association around June 2010, as a corporation with the main purpose of construction business by obtaining authorization for establishment from the head of Bupyeong-gu, Incheon Metropolitan City.

3) Defendants and N on August 31, 2015 (hereinafter “instant partners”) that died on the part of J, K, L, L, M, and August 31, 2015

(2) On September 30, 2010, the Plaintiff and the instant association concluded a contract for construction work to determine matters necessary to promote the instant project on September 30, 2010 (hereinafter “instant contract for construction work”). On the same day, the Plaintiff and the instant association concluded a cash loan contract with the Plaintiff to lend business expenses, etc. to the instant association pursuant to Article 16(4) of the instant contract for construction work (hereinafter “instant loan for consumption”). The main contents of the contract are as shown in the attached Form.

The instant contract signed and sealed each of the instant members as joint and several sureties.

2) Pursuant to the instant contract, the Plaintiffs were the Plaintiff Company A (hereinafter “Plaintiff A”) with respect to the instant association until the end of 2012.
