A. On August 2, 200, Company I obtained a construction waste interim disposal business license from the Defendant for a place of business located in the Young-gu Busan Metropolitan City J (hereinafter “instant place of business”) and H operates a business upon succession to the rights and obligations of the said license through a report on change on October 2, 2014.

나. 피고는 2018. 10. 23. 원고 B으로부터 이 사건 사업장에 대한 건설폐기물의 재활용촉진에 관한 법률(이하 ‘건설폐기물법’이라 한다) 위반 신고를 받고 위 사겁장의 건설폐기물 보관기준 위반 사항을 확인하였고, 2018. 1. 6. H에 대하여 건설폐기물법 제25조 제2항 제2호, 같은 법 시행규칙 제15조의2 별표3에 따라 영업정지 1개월(영업정지기간 2018. 12. 31.∽2019. 1. 30.)의 처분을 하였다

Meanwhile, the Plaintiffs asserted that they are running or residing in a business within a distance of 1km from the instant business site, and that the Defendant’s interim disposal business of construction waste as of January 30, 2019, suffered damage, such as scattering dust and noise, etc., due to the Defendant’s permission disposition of construction waste interim disposal business.

A. The Defendant’s issuance of the instant permit is merely a factual act unrelated to the rights and obligations of H, and is subject to appeal litigation, as it issued the instant permit upon the expiration of the business suspension period.
