【Criminal Facts】
While the Defendant was living in a old-age without a certain occupation or residence, the Defendant received a proposal to divide the loans or purchase a motor vehicle from a person who was aware of his/her name (hereinafter referred to as the “C Department”) on February 201, and around that time, the Defendant sent three passbooks, including a resident registration copy, resident registration certificate, and a new bank (EF) bank, to use the loan while living in the boarding house located in the high seas-si D.
1. On April 4, 201, the Defendant entered into an installment financing agreement with his/her name in which “the principal of the loan is KRW 15 million, installment period of KRW 36 months, monthly installment payment, KRW 611,573,” and submitted a business registration certificate, etc. as to “H,” a computer repair business entity whose representative is the Defendant, when the Defendant entered into an installment financing agreement with his/her own name, on the part of the second class selling company (ju), the second class selling company of Dobong 2, 643-6, Dobong-gu, Seoul, Seoul, to purchase the vehicle in the part of the victim’s Republic of Korea (ju).
However, the Defendant did not operate the “H” company, and rather, the Defendant did not have the intent or ability to repay the loan even if the Defendant did not receive a loan from the victim due to the lack of certain income or special property.
Nevertheless, the defendant, in collusion with the person who is not aware of his name, by deceiving the victim as above, and by inducing the victim to pay 15 million won out of the price of the above vehicle to the person who is in charge of the Maritime Affairs and Trades (State).
