1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On September 7, 1991, the Plaintiff (1968) was appointed as a policeman on September 1, 201, and was promoted to the police officer on October 1, 2013. From February 15, 2014 to June 7, 2016, the Plaintiff (1968) served in the Gyeongginam Provincial Police Agency Branch B District of the Police Station, and currently served in the same police station C District of the same police station.
B. On June 7, 2016, the Defendant: (a) deemed that the Plaintiff violated Articles 56 and 57 (Duty of Good Faith) of the State Public Officials Act due to the following grounds for disciplinary action following the resolution of the General Disciplinary Committee on Police Officers at the Branch Police Station; and (b) issued a disposition to dismiss the Plaintiff pursuant to Article 78(1)1 and 2 of the State Public Officials Act.
A police officer of a disciplinary cause has a duty to observe all relevant statutes and perform his/her duties in good faith. However, around January 23, 2016, around 18:13, the Plaintiff (F, 20 earlys) filed 112 reports from the “EPC bank” located in Seongbuk-gu, Seongbuk-si, Sungnam-si, with a scambane, and stored a handphone number in his/her cell phone without F’s consent to store the handphone number in his/her cell phone “F”, and then sought F as an EPC bank in early February 2016, 2016, the Plaintiff started to contact him/her on five occasions and demanded private south to contact him/her over five occasions.
