Reasons
1. Details of ruling;
(a) Business Approval and Public Notice - Bogeumjari Housing District Development Project (E District 8 teas, hereinafter “instant Project”) - F on October 14, 2008 and October 1, 2009, published by the Ministry of Land, Transport and Maritime Affairs - Project Operator: Defendant
B. The Central Land Tribunal’s ruling of expropriation on November 16, 2012 (hereinafter “instant adjudication of expropriation”) - Articles subject to expropriation (hereinafter “the instant objects subject to expropriation”): Plaintiff B: 19 obstacles, such as the valleys, fences, etc. located in Goyang-gu, Yangyang-gu, Yangyang-gu, Yangyang-si, Hayang-gu, Hayang-gu, 3 cases of obstacles, such as the boilers located in H: Plaintiff C; 4 cases of 23 obstacles, such as the chickens located in Yangyang-gu, Yangyang-gu, Yangyang-gu, Yangyang-gu; 17,000 won; 2.3,52,50 won: Plaintiff B: Plaintiff C: 90,000 won; 10,000 won or more; 20,000 won or more; and 30,000 won or more; and 4,00 won or more of the entire appraisal and assessment of Plaintiff C; 2,00 won or more.
2. The plaintiffs' assertion
A. From October 14, 2008, the public announcement date of the project approval of this case, on the H land of Goyang-gu, Seoyang-gu, Seoyang-gu, which was expropriated as the project of this case for claiming compensation for obstacles indicated in the separate list, there was each obstacle indicated in the separate list owned by the plaintiffs other than the objects to be expropriated. At the time of the adjudication of expropriation, the payment of compensation was omitted.
Therefore, the Defendant shall pay the Plaintiff KRW 12,585,00, KRW 16,500, and KRW 16,216,500, and KRW 2,800, and KRW 2,500, and KRW 2,812,50, as compensation for the obstacles described in paragraph 5 of the attached Table, to the Plaintiff as compensation for the obstacles described in paragraphs 6 of the attached Table.
B. Plaintiff B’s claim for the payment of business loss compensation amount of Plaintiff B at the time of the instant decision of acceptance.
