1. The Defendant’s KRW 9,00,000 as well as 5% per annum from May 17, 2019 to September 24, 2019 to the Plaintiff.
Reasons
1. Facts of recognition;
A. The Plaintiff completed a marriage report with Nonparty C on December 18, 2006, and brought two children on May 28, 2009 and November 8, 2010, and continued a marital life.
B. From March 2013, the Defendant: (a) around March 2014, around March 2014, sent E messages, such as “Oiss, U.S. Epis,” to C, who worked as an employee of the same company as C; and (b) acted to doubt the inappropriate relationship.
C. Around December 22, 2018, the Defendant sent text messages to C to the effect that “I am only in the face of another male. I am good. I am good. I am love.” The Defendant expressed his/her intent to continue to wait for the time when arranging the relationship.”
Around January 5, 2019, the Defendant sent a text message to the Plaintiff that the Plaintiff sent a photograph verifying that the E dialogue (the content that C asks the Defendant with an inner part of a half-yearly, send E dialogue to the Defendant), which was divided by the Defendant and C, had been sent to the Plaintiff, along with a photograph confirming that the trip was a tobacco-related relationship stamped, and on January 7, 2019, “the Defendant and C had good, good, good, and good.”

2. In principle, the act of a third party causing damage to a spouse by committing an unlawful act with the spouse, thereby infringing on or impeding the maintenance of a marital life falling under the essence of marriage and infringing on the spouse's right as the spouse. According to the above facts of recognition, the defendant committed an unlawful act, such as entering into a relationship with C, knowing that C has a spouse, and notified the plaintiff of this fact. Since the defendant's act infringed on the spouse's common life of the plaintiff and C, the defendant has a duty to take monetary compensation for mental suffering suffered by the plaintiff.
