1. The Defendant owns an automobile listed in the separate sheet from the Plaintiff on August 29, 2014.

The facts of recognition reveal that the Plaintiff is a corporation for the sale of a motor vehicle or the sale and brokerage of a used motor vehicle, etc., and is the owner of the motor vehicle listed in the separate sheet (hereinafter “the instant motor vehicle”), and the Defendant was awarded a successful bid for the instant motor vehicle sold by the insurance company through an online sales system operated by the Plaintiff on August 26, 2014, and the Plaintiff confirmed the deposit of KRW 33,920,000 for the vehicle price in the name of the depositor’s “CD” and “E” on August 29, 2014, and confirmed the fact that the delivery of the instant motor vehicle to the Defendant does not conflict between the parties, or that it was delivered to the Defendant in full view of the purport of the entire pleadings

2. Determination

(a) A person who takes over a registered motor vehicle shall file an application with the Mayor/Do Governor for the registration of transfer of ownership of the motor vehicle, and where the transferee of the motor vehicle fails to file an application for the registration of transfer, an owner recorded in the register may file an application for the registration of transfer on behalf of the transferee (Article 12 (1) and (4) of the Motor Vehicle Management Act), and any person recorded in the register as an owner of the motor vehicle may seek the registration of transfer on behalf of the transferee as well as the person who directly takes over the motor vehicle from

As seen earlier, insofar as the Defendant was aware of the fact that it was awarded a successful bid on August 29, 2014 and paid the price thereof, it is reasonable to deem that the Defendant purchased the instant motor vehicle around that time. As such, the Defendant is obligated to take over the registration procedure for transfer of ownership for the Plaintiff registered as the owner on the registry on August 29,

B. As to this, the Defendant only arranged the sale of the instant vehicle and acquired it.
