A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2014. 5. 13. 22:00경 경부고속도로 송탄톨게이트 부근에 있는 D식당 앞 노상에서 스마트폰 구글 어플리케이션 즐톡을 통하여 알게 된 피해자 E(여, 12세)로부터 집을 나와 갈 곳이 없고 이전에 24살짜리 남성과 성관계를 가진 사실이 있다는 말을 듣고는 하룻밤을 재워주기로 하고 피해자를 만나서 같은 날 23:00경 피고인 운전의 앞 번호 불상 F 봉고 프런티어 화물차 조수석에 피해자를 태워 안성시 G 주변에 있는 무인텔인 H 모텔로 운전하여 간 다음 그곳에 있는 현금투입기에 현금 3만원을 투입하여 숙박비를 지불하고 피해자를 데리고 위 모텔 208호로 들어가 1회 성관계를 하고 피해자에게 간식과 차비 1만원을 제공함으로써 아동청소년의 성을 사는 행위를 하였다.
