A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From around 2013, the Defendant had been punished for violating the School Health Act on two occasions in 2014 while operating a massage business, a rest room, or an image club with the trade name of “C” in Jeju-si, Jeju-si, and continued to operate the above image club even though it had been punished for violation of the School Health Act.

1. Around October 17, 2014, the Defendant violated the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. (the Act on the Punishment of Commercial Sex Acts, Etc.) installed a smuggling room equipped with bed and shower rooms, etc. in the “C” operated by the Defendant on the ground of Jeju-si, which had been equipped with bed and shower rooms, etc., in return for sexual traffic from many unspecified male customers who found the said place, and provided 120,000 won in cash and 130,000 won in return for sexual traffic, and provided 69,000 won in cash to female employees D (n, 49 years of age) with the above amount, and controlled the police over the above male customers and sexual intercourse. On March 23, 2015, the Defendant continued to receive 120,000 won in cash from the above “C” around 30, 2015 to arrange sexual traffic during the said period.

2. Any person who violates the School Health Act shall be prohibited from providing any service or facility that leads to physical contacts between unspecified persons, exposure to confidential parts, etc., or that is likely to commit any act similar thereto, within school environmental sanitation and cleanup zone;

Nevertheless, from April 16, 2014 to March 23:30, 2015, the Defendant installed and operated facilities that are likely to cause physical contacts to unspecified persons, such as sexual traffic, similarity or dancing, petance, and sediment, by installing a shower facility inside the image club located in the school environmental sanitation and cleanup zone.
