A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant, on December 19, 2016, puts on the Internet Health Market (www. Hllomet.com) website using smartphones at the Defendant’s residence, Cheongju-si B, 304 Dong 1102, 1102, Cheongju-si, Cheongju-si, Cheongju-si, and the Defendant stated that the Defendant would immediately transfer KRW 150,000 to the Defendant’s bank account and send the goods to the victim C who had contacted with the Defendant around January 19, 2017.

The Defendant was transferred 150,000 won to the Agricultural Cooperative Account (D) in the name of the Defendant for the purchase price for heavy trading around 11:24 on the same day from the injured party.
Accordingly, the defendant was given property by deceiving the victim.
2. No person, other than the Seoul Olympic Sports Promotion Foundation or an entrusted business entity, shall engage in any act of providing property or property benefits to persons who win the results of sports promotion by issuing voting rights or things similar thereto, or gambling using such rights;
Nevertheless, the Defendant, from November 19, 2015 to April 30, 2017, visited E, etc., a website operated by the Defendant using a computer at the Defendant’s residence, etc. from around November 19, 2015 to around April 30, 2017, by using smartphones, deposited money into the borrowed-name account used by the said Defendant, received cyber money equivalent to the deposit amount, and predicted the result of various overseas and domestic sports games in advance, thereby putting up cyber money, and putting up dividends on a total of KRW 109,448,600, total sum of 958 times, such as written in the list of crimes committed by the Defendant.
