1. The Plaintiff:
A. Defendant C shall pay KRW 37,00,000 and a rate of 20% per annum from June 6, 2015 to the date of complete payment.
Reasons
1. Facts of recognition;
A. Defendant B’s status as the Defendants is a licensed real estate agent (i.e., the name of the E Licensed Real Estate Agent Office on February 5, 2015) operated on February 5, 2015, and Defendant C was a broker assistant of Defendant B.
B. On September 18, 2014, the Plaintiff entered into a studio rental agreement (20 million won, monthly rent of 50,000 won) with the introduction of Defendant C, and the Plaintiff transferred the down payment of KRW 2 million to Nonparty F’s account known to the said Defendant, and then transferred the said KRW 3 million again on October 20 of the same month to the same account. (ii) On October 2014, Nonparty G visited the E Licensed Real Estate Agents’ office to request brokerage of the 305 H building in Nam-gu, Nam-gu, Seoul (hereinafter “instant building”). Upon recommending the Plaintiff to make a lease agreement of the instant building, the Defendant C provided a monthly contract of KRW 30 million,00,000,000,000,000,000,000 won, which was KRW 500,000,000,000 to the Plaintiff’s account.
3) On October 27, 2014, Defendant C entered into a lease agreement on the instant building (a security deposit of KRW 30 million, monthly rent of KRW 70,000,000, and KRW 70,000,000,000; hereinafter referred to as “contract dated October 27, 2014”).
A) Around December 12, 2014, the Plaintiff paid the remainder amount of KRW 25 million and KRW 70,000,000 to the above Defendant. Around December 12, 2014, Defendant C provided that the lessor of the instant building would have increased the deposit amount of KRW 10,000 and demand KRW 50,000 per month. Upon consent to the said terms and conditions, the Plaintiff transferred KRW 10,000 to the account of Nonparty J as stated in the contract signed by the lessor on October 27, 2014. The Plaintiff received from the above Defendant a lease contract stating the lessor’s J, deposit of KRW 40,00,000 and KRW 50,000 per month.
