A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On March 15, 2013, the Defendant was sentenced to ten months of imprisonment for fraud at the Changwon District Court, which became final and conclusive on March 23, 2013.

1. On May 2009, the Defendant stated that “A private teaching institute “D” located in Seongbuk-gu, Changwon-si, Sungwon-si, Sungwon-si, would pay the victim E the proceeds of KRW 200,000 after 15 days if a person who is aware of the fact is operating a housing auction business, and invests KRW 3 million in the investment.”

However, in fact, the defendant did not have any person who is running the housing auction business at the time, and the defendant did not make any profit by investing in the auction, and he did not have any intent or ability to pay the profit even if the victim made an investment in the housing auction business, and he thought that he used the money received from the victim as his smuggling card price.

The Defendant, as such, by deceiving the victim, received KRW 3 million from the victim around May 6, 2009.

2. On May 2009, the Defendant stated to the victim E at the same place as the preceding paragraph of the Korean War on May 1, 2009 that “as the Defendant opened a house located in Sung-gu, Sungwon-si F by auction, it would be purchased,” and that the Defendant changed money for the purpose of purchasing a house.

However, the defendant did not have any intention or ability to purchase a house even if he received money from the victim because he was unable to return the card price without any particular property or profit at the time.

The Defendant, as such, by deceiving the victim, received the total amount of KRW 10 million from the victim on May 20, 2009, KRW 15 million on May 21, 2009, KRW 18 million on May 26, 2009, KRW 200,000 on June 23, 2009, KRW 500,000 on July 27, 2009, KRW 330,000 on August 11, 2009, KRW 300,000 on August 18, 2009, KRW 15 million on August 26, 2009, KRW 4 million on October 7, 2009, KRW 2008 on June 28, 2008.

3. On November 1, 2009, the Defendant: (a) purchased a house by auction at a team on the infinite (hereinafter referred to as “infinite”); and (b) purchased a house by auction.
