Defendant shall be punished by a fine of 1.5 million won.

If the defendant does not pay the above fine, KRW 100,000.

Summary of Evidence

1. The defendant's legal statement (as at the date of the second public trial, in the case);

1. A protocol concerning the examination of the police officers of the accused;

1. B written statements;

1. Application of Acts and subordinate statutes to the internal investigation report (victim's taxi booms and voice analysis) and the photographic image of black booms;

1. Relevant Article of the Criminal Act and Articles 261 and 260 (1) of the Criminal Act concerning the selection of punishment for a crime;

1. Articles 70 and 69 (2) of the Criminal Act to attract a workhouse;

1. The punishment as ordered shall be determined by taking into consideration all the circumstances revealed in pleadings, such as the details of the crime for sentencing under Article 334(1) of the Criminal Procedure Act, the degree of violence by the defendant, the circumstances after the crime, the defendant's opposite nature, the age and health of the defendant, family relationship, living environment, etc.
