Purport of claim and appeal

1. The plaintiff filed a claim for damages against the defendant and the claim for damages caused by embezzlement.

The first instance court dismissed the claim for damages caused by deception, and partly accepted the claim for damages caused by embezzlement. However, it is clear that only the defendant filed an appeal against the judgment of the first instance court. Thus, the scope of the judgment of this court is limited to the claim for damages caused by embezzlement partially quoted in the judgment of the first instance.

2. The reasoning of the court's explanation of this case is as follows: (a) the statement of the reasoning of the judgment of the court of first instance concerning this case is as follows: (b) the statement of the reasoning of the part of the judgment of the court of first instance (except for the part concerning the claim for damages caused by an act of tort (excluding Chapters 4-2 and 12), and 420 of the Civil Procedure Act) is the same as that of the part concerning the defendant (excluding the part concerning the claim for damages caused by an act of tort) in the judgment of the court of first instance, except for the part concerning the claim for damages caused by an act of tort (Article 12-14, 18, 19, 21, and 22).

3. If so, the plaintiff's claim for damages caused by embezzlement among the plaintiff's claim against the defendant is justified within the scope of the above recognition, and the remaining claims are dismissed as it is without merit.
