1. The Defendants are jointly and severally liable to the Plaintiff for 37,037,770 won and 5% per annum from February 15, 2012 to May 15, 2015.

1. Basic facts

A. A. Around 2011, around 2012, Defendant B, as the representative director of Nonparty E (hereinafter “Nonindicted Company”) established for the purpose of selling goods, buying agency, and selling visit sales business, etc., Defendant B took overall charge of investment solicitation of the said company’s funds and investors. Defendant C recruited investors by offering a business explanation on the method of distributing investment proceeds with the president of Daegu Branch of Nonparty Company and vice president. Defendant D recruited investors from the Daegu Branch of Nonparty Company to the Daegu branch of Nonparty Company as the Daegu branch of Nonparty Company.

B. From around 2011 to around 2012, the Defendants: “At present, E would raise profits from the operation of the Internet sale and auction site of F and G, and later would make profits from the operation of the H site, which is the site to sell the goods of Korea-China in Hong Kong. The method of investment is 60,000 won per one unit; 60,000 won where 660,000 won are paid as coophones eligible to invite an auction on the Internet and the remainder 60,000 won will be paid within 1-20,000 won per day from 7 days after the investment to 200,000 won added to the principal. In the event of attracting investors, 3% of the investment amount would be paid as allowances to the solicitors; and later, in the event of attracting investors, it would operate the relevant auction site by dividing the goods possessed by Korea-China from Hong Kong on June 2012, which would have played an important role in operating the auction site at the Hong Kong.”

C. On December 201, the Plaintiff received investment recommendations from Defendant C, D, etc. to the aforementioned purport, and up to February 15, 2012.
