A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Game Industry Promotion Act;

(a) No one shall produce, distribute or provide game products which are not provided or approved by a game water-related business entity;

그럼에도 불구하고 피고인은 2016. 9. 1. 경부터 2017. 7. 11. 경까지 고양시 일산 서구 E에 있는 306동 1002호 또는 고양시 일산 동구 F에 있는 628호에서 게임관련사업자인 ㈜ 넥슨에서 개발 및 서비스 제공 중인 " 메이 플 스토리" 게임을 모방한 “G” 게임에 접속할 수 있도록 “ 메이 플 스토리” 게임의 접속기 프로그램의 IP 주소를 피고인의 사설 서버 IP 주소로 변경하는 등 접속기 프로그램을 복제, 변조, 배포하는 방법으로 ‘H (H, url 주소 : I 등 8개)’ 사설 서버와 이에 접속할 수 있는 프로그램을 갖춘 다음 이를 불특정 다수의 사설 서버 회원들에게 제공하여 게임 물관련사업자가 제공하지 아니한 게임 물을 불특정 다수의 회원들에게 제공하였다.
