Reasons
Facts of recognition
On April 6, 2004, the head of the Seoul Metropolitan Government announced the implementation plan for the urban planning facility project (road) project pursuant to Article 88 of the former National Land Planning and Utilization Act (amended by Act No. 8250, Jan. 19, 2007; hereinafter “National Land Planning Act”) and Article 97 of the Enforcement Decree of the same Act for the construction of the G road around the G road in the Gangseo-gu Seoul Metropolitan Government Fdong (hereinafter “instant public project”) and publicly announced as H of the Seoul Metropolitan Government.
The Defendant acquired each land of this case through consultation for the public works of this case, as shown in the separate sheet, acquired each land owned by the Plaintiffs (hereinafter “each land of this case”) and paid compensation.
Of each of the instant lands, the G-gu Seoul Metropolitan Government 964 square meters was divided into 460 square meters for I, J 127 square meters, and K 377 square meters for each of the instant lands. L 229 square meters was divided into 35 square meters for L 28 June 28, 2006, 35 square meters for M 35 square meters, and 159 square meters for N 159 square meters for L 229 square meters.
Pursuant to Articles 3 and 4 of the former Urban Development Act (wholly amended by Act No. 8852 of Feb. 29, 2008), the head of the Seoul Metropolitan Government promoting the instant urban development project shall designate the Gangseo-gu Seoul Metropolitan Government Odong, Pdong, Fdong, Qdong, Qdong, R 3,364,00 square meters as S, including each of the instant land on December 28, 2007. The president of the EP Corporation shall be the project implementer to develop a development plan to create the apartment housing site, commercial site, business site, infrastructure site, and other facilities site within the said zone, and shall be publicly notified as T-gu Seoul Metropolitan Government. On December 30, 2008, the said development plan was partially amended and the implementation plan for the S Development Project (hereinafter “instant urban development project”) was approved and publicly notified as U.S. announced.
On June 17, 2011, the Defendant registered the transfer of ownership on the ground of an agreement on the acquisition of public land on June 30, 2010, with respect to the I 460 square meters, L 35 square meters, M 35 square meters, M 35 square meters, N 159 square meters, and V 327 square meters.
