For the reasons indicated in its holding, the lower court upheld the first instance judgment that acquitted the primary charges of this case on the ground that there is no proof of crime, and acquitted the Defendant on the ground that there is no proof of crime as to the ancillary charges of this case added by the lower court.

In light of the records, the above judgment of the court below is just, and there is no error in violation of the principle of free evaluation of evidence against logical and empirical rules.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
