1. Of the land size of 1,545 square meters in the East Sea owned by the Defendant, the annexed drawing Nos. 28, 38, 39, 40, 30, 31, 32, 34, 45, and 46.

1. Facts of recognition;

A. The Plaintiff owns 2,291 square meters prior to E in the East Sea (hereinafter “Plaintiff’s land”). The Defendant owns C-1,545 square meters of forests and fields and 314 square meters of forests and fields (hereinafter “Defendant’s land”).

B. The Plaintiff cultivated the Plaintiff’s land as dry field.

On the Defendant’s land, the passage roads in the form of farm road is naturally formed (hereinafter “instant passage roads”) and the part of the passage roads is difficult for the Defendant to pass through the farm machinery, etc. by planting seedlings and installing a water pipe and piling up a fertilizer.

C. Subsequent to the Plaintiff’s land, the following land is located in mountain, and the Defendant’s land is located between the Plaintiff’s land and its meritorious service.

원고의 토지로부터 공로에 이르기 위하여는 피고의 토지상의 이 사건 통행로를 거쳐 개천 위에 설치된 공용 다리를 건너거나, 원고의 토지 뒤편에 있는 F 임야 쪽으로 빙 돌아서 E 토지 위를 가로질러 G 토지 쪽으로 우회하여 난 약 160m 이상의 상당히 먼 거리의 좁은 샛길을 통과해야 한다.

위 샛길은 중간에 길이 패이고 경사가 심하여 보행조차 쉽지 않은 상태이다
