1. The Defendant: (a) KRW 55,00,000 for Nonparty C and each Plaintiff; and (b) from June 20, 2018 to November 20, 2018, for these reasons.
Reasons
1. Determination on the cause of the claim
A. The following facts are acknowledged in full view of the respective descriptions and the purport of the whole pleadings by Gap's evidence Nos. 1 to 3:
1) The defendant and the non-party C are part of 64 square meters among the buildings located in the Dong-gu Busan Metropolitan City D (hereinafter "the instant real estate").
(2) As the owner of the instant real estate on April 26, 2018, a lease agreement between the Plaintiff and the Plaintiff on April 26, 2018, the lease deposit amount of KRW 55 million, monthly rent of KRW 250,000, and the lease term of KRW 10,000 from May 10, 2018 to May 9, 2020 (hereinafter “instant lease agreement”).
(2) On May 10, 2018, the Plaintiff concluded the instant lease agreement with the National Housing Fund supported by the Government for the stabilization of housing of the vulnerable class in housing, and paid KRW 55 million to the Defendant and Nonparty C the lease deposit.
3) However, the defendant and the non-party C did not perform their obligations, such as mooring, replacement, repair of defects, etc. under the instant lease agreement, and the non-party E was unable to move into the instant real estate. Accordingly, on June 19, 2018, the plaintiff notified the defendant and the non-party C of the cancellation of the instant lease agreement by the lessor’s negligence. B. According to the above recognition, the instant lease agreement was lawfully rescinded upon the notification of the plaintiff’s cancellation. As such, the defendant and the non-party C were obligated to pay to each of the plaintiff the lease deposit amount of KRW 55 million from June 20, 2018 to November 20, 2018, the delivery date of the copy of the complaint of this case, with the annual interest rate of 5% as stipulated in the Civil Act, from November 21, 2018 to May 31, 2019 to June 21, 2019 to June 19, 2019.
