A defendant shall be punished by imprisonment with prison labor for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant was a person operating the e-mail in Pju City, B, and C was aware of the fact that it became difficult to operate the e-mail. On May 25, 2016, the Defendant used the name of the above C to change the name of the business operator who lent the name from the above C to the above C. On July 7, 2016, the Defendant purchased one 19.2 million won borrowed from the above C’s name from the victim D Co., Ltd. and operated the e-mail. While the operating fund was insufficient, the Defendant did not want to receive the above C loan without the permission of the above C, using the E-association account, credit card, identification card, etc. in the above C’s name, which was received from the above C.

Around December 20, 2016, the Defendant, despite having not obtained permission for credit loans of KRW 18 million from the above C, notified the F, an employee of the victim company, of personal information, such as the date of birth of the said C, and applied for the credit loans of KRW 18 million, as if he/she had been granted a legitimate authority over the loans from the said C.

The Defendant, as such, by deceiving the victim company, received from the victim company the remittance of KRW 18 million under the name of the E-Union account in the above C on the same day.

2. On August 28, 2017, the Defendant informed G, an employee of the victim company, of personal information, such as the date of birth of the said C, and applied for a credit loan of KRW 2 million, even if he/she did not obtain permission for the credit loan of KRW 2 million from the said C.

The Defendant, as such, by deceiving the victim company, received KRW 2 million from the victim company to the EUnion account in the same day.
