A defendant shall be punished by imprisonment for a period of five months.
Seized smartphones (SM-N976N) (No. 1) shall be confiscated.
Reasons
Punishment of the crime
No one shall borrow or lend a means of access or keep, deliver or distribute a means of access while demanding, demanding or promising compensation in using or managing the means of access.
Nevertheless, on May 23, 2020, the Defendant reported job offer advertisements to the effect that “the Defendant seeks high-amount eggs” at the Internet B site, and proposed that “the Defendant will provide KRW 50,000 won per unit of delivery,” from the person under whose name the communication was made, to the effect that “the Defendant will deliver the phone-line, KRW 50,000,000 won per unit of delivery.” However, the Defendant was aware that the delivery of the goods is a physical check and the said physical check was used for the crime of telephone financial fraud (one-name “mail”). However, the Defendant agreed to deliver or keep the physical check under another’s name.
1. Delivery of means of access;
A. On May 24, 2020, the Defendant: (a) around 10:59 on May 24, 2020, pursuant to the direction of the person who was unable to receive the name; (b) collected one box containing one box and one box containing one G body card (credit number H) in the name of Yeongdeungpo-gu Seoul Metropolitan Government, Yeongdeungpo-gu, Seoul, in order to display the unmanned-do Green Children Park; (c) around 10:59 on May 24, 2020; and (d) received KRW 1.30,000 in return.
Accordingly, the defendant delivered the means of access while receiving compensation.
B. On May 25, 2020, the Defendant: (a) around 15:00 on May 25, 2020, according to the direction of a person who was not killed in the name of the Defendant, opened one physical card connected to L’s account from J and K to L’s account; (b) around 18:00 on the same day, the Defendant received one physical card connected to Q’s R(S) account from the P Guard Office located in Suwon-si, Suwon-si, Suwon-si; and (c) delivered a box with one physical card connected to Q’s name from the P Guard Office located in Suwon-si, Suwon-si; and (d) on the same day, around 19:00 on the same day.
