1. Basic facts

A. The Plaintiff is a person residing in Gangseo-gu E-ground housing (hereinafter “Plaintiff housing”); Defendant B is a person who newly built a studio 21 household building on the ground of Gangseo-gu Seoul Metropolitan Government F land abutting on the Plaintiff’s housing (hereinafter “instant building”); Defendant C is a supervisor of the instant new building construction project, a certified architect who designed the instant building in the construction of the new building, and Defendant D is a supervisor of the instant building construction project.

B. The instant building was commenced on September 2016 and completed and obtained approval from the head of Gangseo-gu Office.

Among the instant buildings, 21 gas meters was installed on the outer wall abutting on the Plaintiff’s housing. In the same direction, 1, 2, and 3 floors of the instant building were installed on each floor, 7 boilers were installed in each boiler room, and gas pipes connected to urban gas pipes were connected to 21 boilers via the said gas meter.

In each boiler installed on the 1, 2, and 3th floor of the instant building, seven burning gas emissions are placed in the direction of the Plaintiff’s housing for each floor, and the combustion emissions are being emitted from the said outlet whenever boiler is operated.

A. The Defendants not only violated relevant statutes while constructing the instant building, but also failed to perform the gas pipeline construction works as follows, as the owner, designer, and supervisor of the instant building, but also failed to install three gas boiler rooms, 21 gas meters, and all gas external outlets at the road, parking lot, and entrance direction, which are open together with the neighboring building.
