1. The Defendants jointly and severally agreed to the Plaintiff KRW 434,653,933, and 5% per annum from May 16, 2015 to October 13, 2017.
Reasons
1. Basic facts
A. 1) On June 9, 2009, the former Local Government Procurement Service under the Plaintiff’s control announced a public announcement of the “E New Construction Corporation” on the D ground (hereinafter “the instant construction project”). The Defendants and the non-party F Co., Ltd. (hereinafter “F”) constituted a joint supply and demand company (the representative company: Defendant A: hereinafter “the instant joint supply and demand company”) for the receipt of the instant construction project. At the time, the share ratio was 33% by Defendant A Co., Ltd. (hereinafter “A”), Defendant limited liability company B (hereinafter “B”), 15% by Defendant C (hereinafter “C”), and 30% by the F Co., Ltd.
3) On August 10, 2009, the Plaintiff specified the first construction period from August 14, 2009 to March 11, 2010 with respect to the instant construction project as the total construction period (1,080 days) from July 28, 2012 (i.e., the first contract amount of KRW 3.96 billion, the total construction amount of KRW 2.32 billion, and the construction amount of KRW 2.32 billion (hereinafter “instant construction contract”); and hereinafter each of the following contracts as the “instant construction contract”.
(4) On the other hand, the shares of the Defendants were adjusted to Defendant A47%, Defendant B31.5%, and Defendant C21.5% as the F, upon whom the rehabilitation decision was rendered on December 2010, was withdrawn from the above joint supply and demand organization.
5) On April 17, 2013, the sixth construction contract was concluded between the Plaintiff and the Defendants as the contract amount of KRW 4.5 billion and the construction period from April 18, 2013 to December 1, 2013 (after the change to December 15, 2013). After December 5, 2013, the said six construction contract amount was reduced to KRW 576,097,000, and was reduced to KRW 3,924,903,00. (b) On December 17, 2013, the general conditions of construction contract under the instant construction contract (i.e., the general conditions of construction contract under the instant construction contract) which were the contents of the instant construction contract (i.e., the general conditions of construction contract under the instant construction contract).
