1. Defendant B Co., Ltd. shall pay to the Plaintiff KRW 2,00,000,000 as well as to the Plaintiff from September 15, 2014 until June 16, 2017.
Reasons
1. Basic facts
A. The Plaintiff is a company with the purpose of aggregate extraction business, soil industry, etc., and Defendant B Co., Ltd. (hereinafter “Defendant B”).
) E development projects (hereinafter referred to as “instant development projects”)
(2) Defendant C Co., Ltd. (hereinafter “Defendant C”) (hereinafter “Defendant C”) held capital of KRW 5,00,000 (one share, KRW 10,000, total number of issued and outstanding shares, KRW 500,000) as a project financial investment company and a special purpose corporation established on November 27, 2013 and for the purpose of establishing, raising, and operating, managing, and supporting the instant development project. 2) Defendant C Co., Ltd. (hereinafter “Defendant C”) held capital of KRW 5,00,000 (one share, KRW 10,000, total number of issued and outstanding shares, KRW 50,000, KRW 500, KRW 7000 of its issued and outstanding shares, KRW 50,000 of its issued and outstanding shares, and KRW 50,505,000 of its issued and outstanding shares, each of its respective shares of H Co., Ltd. (hereinafter “F”) at the time of its incorporation.
3) Defendant D Co., Ltd. (hereinafter “Defendant D”)
(B) For the purpose of implementing the instant development project, the company was established on May 21, 2015 with capital of KRW 1,000,000 (10,000 per share, total number of issued and outstanding shares), and at the time of its establishment, Defendant C owned all of its issued and outstanding shares. (B) On September 10, 2012, H and J (hereinafter “J”) established a special purpose corporation for the implementation of the instant development project by creating K Complexes with H and J (hereinafter “the instant land”) on the land listed in the separate sheet (hereinafter “the instant land”). The company’s investment and cooperation to recommend and provide administrative support necessary for the procedure so that the foregoing special purpose corporation purchases the instant land from the Korea Land and Housing Corporation.
