A defendant shall be punished by imprisonment for two years.

Punishment of the crime

The defendant of "2016 Highest 941" is a director of "B" who works for a shopping mall.

Around May 17, 2016, the Defendant made a false statement to the effect that “B offices located in Jung-gu Seoul, Seoul, would be a director of B'B clothes shopping mall, and if the introduction fee is paid, would allow G stores to be sold by the end of August 2016 through E-related F.

However, at the time, the defendant was an urgent situation to repay principal and interest when the debt exceeds KRW 370,000,00, and the amount received from the victim was merely a personal thought to be used by the defendant, such as repaying the defendant's own debt. Even if the amount was received from the victim, the victim did not have the intention or ability to sell it to G burial.

Nevertheless, the Defendant: (a) by deceiving the victim as above; (b) received KRW 10,00 from the victim to the Defendant’s Nonghyup Bank account (H) under the pretext of introduction around May 17, 2016; and (c) received a total of KRW 185,200,00 from the Si to July 5, 2016, a total of 14 times in the name of introduction fees, premiums, deposits, etc., as shown in attached Table 1.

Accordingly, the defendant acquired 185 million won from the victim by fraud.

"2018 Highest 6390"

1. On July 6, 2016, the Defendant, while drinking alcohol at the “J” entertainment tavern located under the first floor of the building located underground in Gangnam-gu Seoul, Gangnam-gu I, said that “B is a director B, who is an employee of the said establishment, may also borrow money, and may make a full payment instead of prepaid money.”

However, from 2010 to 2010, the Defendant had no intention or ability to settle the price even if the Defendant had been provided alcoholic beverages, etc. from the victim for the debt amounting to 370 million won at the time.

As above, the defendant deceivings the victim and belongs to it.
