Reasons
Punishment of the crime
1. From March 4, 2013 to April 23:20, 2013, Defendant A: (a) installed a total of 25 games, including 12 per gift certificates or 12 points per gift certificates or 5,000 won per fee, and operated the said games; (b) opened the games by having many unspecified customers suffering from 10,000 won for each of the above games; and (c) opened the games by dividing the first one into the first one; and (d) if the pictures or numbers coincide with each other on the screen, the gift certificates discharge (e.g., per gift certificates or 5,000 won per gift certificates or per fee acquired from the game (e., yellow game).
Accordingly, the defendant was engaged in speculative activities using speculative gaming machines as a business.
2. Defendant B, on April 7, 2013, was employed by Defendant B as an employee in the instant game room operated by A from around 19:00 to April 23:40, 2013, and made it easy for Defendant B to commit the crime by taking advantage of the character, exchange, etc. of customers who found the place.
Accordingly, the defendant aided and abetted A's violation of the Act on Special Cases concerning Regulation and Punishment of Speculative Acts.
3. On April 4, 2013, Defendant C established a surveillance camera at a speculative game room operated by Defendant C from G to G, and upon receiving a request from A to assist in the work of the game room, Defendant C installed a surveillance camera on the entrance, around April 5, 2013.
From April 7, 2013 to April 8, 2013, the Defendant made it easy for the Defendant to commit the crime by providing education, etc. on the game site, exchange, employee, etc.
Accordingly, the defendant aided and abetted A's violation of the Act on Special Cases concerning Regulation and Punishment of Speculative Acts.
