1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Details of the decision on the petition review of this case;

A. On March 1, 2015, the Plaintiff was newly appointed as C University (hereinafter “instant university”) visual designs and non-retirement class assistant professors (education priority teachers, contract term of between March 1, 2015 and February 28, 2017) operated by the school foundation B (hereinafter “instant university”), and thereafter, the Plaintiff is a person whose contract term has been extended up to February 28, 2021 through two reappointments.

B. On March 21, 2017, the principal of the university of this case notified the non-retirement class members who wish to examine the conversion appointment of the retirement age group (hereinafter referred to as “non-retirement class teachers”) on March 1, 2019 pursuant to the Regulations on the Appointment of the Non-Retirement class (hereinafter referred to as the “Rules”) of the Educational Foundation B, and submitted an application for the examination of the transition of the non-retirement class (examination period: from March 1, 2017 to February 28, 2019) to the Department of the University of this case on March 31, 2017.

C. On February 11, 2019, the university teachers personnel committee of the instant case deliberated on whether to recommend non-retirement track teachers who applied for a review on the conversion of the retirement track, and decided to recommend 15 of the 20 applicants to replace the retirement track, and the remaining five of the applicants including the Plaintiff, to be excluded from the proposal.

The president of the University of this case, on February 20, 2019, announced the 15 list of the 15 teachers who are converted to the retirement age track as of March 1, 2019, through “the notification of the fact that he/she is subject to the conversion of the retirement age track as of March 1, 2019,” and “the notification of this case.”

On March 12, 2019, the Plaintiff asserted on March 12, 2019 that the school foundation B excluded himself from those subject to the transition appointment of the retirement age group on March 1, 2019 through the instant public notice constitutes a rejection disposition of the transition appointment of the retirement age group, and filed a petition for the review of its revocation.

On June 5, 2019, the defendant's act of school foundation B excluding the plaintiff from the person eligible for the transition of the retirement age group shall improve the status of teachers and educational activities.
