1. Of the judgment of the court of first instance, the part against the plaintiffs falling under the following order of payment shall be revoked.

1. Basic facts

A. From around 2005, the Defendant granted subsidies to “project to create a mountain ginseng cultivation complex” or “project to create a mountain village ecological village,” which is conducted within the jurisdiction of forests and fields, etc., and around April 2014, the Defendant carried out “forest tending project” which includes livering work in forests and fields, etc.

B. The Plaintiffs received subsidies from the Defendant from around 2007 to around 2009 as a person eligible for support for the project to develop the mountain ginseng cultivation complex, and cultivated mountain ginseng from the Defendant’s forest land (the business site in 2007), 1, 2, 33, and 1 of the mountain land (the project site in 2008, 208, 1, 2 through 33, and 1 of the attached table “survey land” (hereinafter “instant forest”) and 3, N forest land (the project site in 2009).

C. The Defendant’s support project for the creation of a mountain ginseng cultivation complex is a project that supports 60% of the seed price and labor cost incurred by those eligible for support, such as the Plaintiffs, for the cultivation of mountain ginseng.

The status of the Defendant’s support project for the creation of the mountain ginseng farming complex in 2008 against the Plaintiffs on the instant forest is as follows. D. On January 2014, the Defendant: (a) selected four parcels of land, including the instant forest, as the subject of “forest tending project”; (b) decided to take care of “natural forest”; and (c) started from April 17, 2014 through April 19, 2014 to April 19, 2014, part of the instant forest land and YYO (attached Form 34,35 through 64, and 34 among “survey appraisal” (attached Form 34,35 through 64, and 34 among “survey appraisal”); (d) as part of the instant forest tending project, the part corresponding to the instant forest is deemed as part of the instant forest tending project (hereinafter “damage area”).
