1. Basic facts

A. U.S. Co., Ltd. (hereinafter “U.S. Co., Ltd.”) is a company running a business to purchase W and eight parcels of land in Seongbuk-gu, Seongbuk-gu, Sungnam-si (hereinafter “instant business”).

B. The non-party company entered into each of the following real estate sales contracts (hereinafter “each of the instant sales contracts”) with the Defendants, the owners of the land AB in Seongbuk-gu, Seongbuk-gu, Sungnam-si. Defendant J received the down payment from the non-party company on March 16, 2008, and the remaining Defendants received the down payment from the non-party company on April 4, 2008.

C. Each of the instant sales contracts is commonly stated as follows:

Article 2 (Purpose of Contracts and Matters of Special Agreement)

1. The purpose of this Agreement is to purchase the entire land listed in the separate sheet of the Si/Gu, including the real property owned by “A”, for the purpose of “B” and “A” to prescribe the rights and obligations between “A” and “B” in selling and consenting thereto.

2. This Agreement shall be listed in the attached Table of the Gu, including the property owned by “A”.
