1. The summary of the facts charged is that the Defendant is the vice president and vice president of “B”, a general daily newspaper located in the Daegu-Gyeongbuk-do region.

No person shall publish false facts about a candidate (including a person who intends to become a candidate) by means of a speech, broadcast, newspaper, communications, magazine, poster, publicity document, or any other means, with the intention of preventing him/her from being elected.

Nevertheless, on April 29, 2018, the Defendant: (a) as the title “G” around 21:43 on April 29, 2018; and (b) registered on the website of the C-Gun Office on December 29, 2016, the Defendant had received warning from the C-Gun from the C-Gun Office; and (c) recently registered the fact on the website of the C-Gun Office; (d) recently, the place where the Defendant received warning from the C-Gun Office was located outside of one of the C-Gun of the Daegu-Si/Gu, Daegu-si; and (e) prepared an article stating that “The issue of the C-Gun law enforcement system and the administration of more C-Gun,” and posted it on the B-site on the B-site. On April 30, 2018, a candidate for the C-Gun election of the 7th local government election as the administrative officer of the C-Gun.
